
Mindful Warrior Alliance Terms of Service

TERMS OF SERVICE/CLIENTS
Welcome to Mindful Warrior Alliance (MWA), a network of licensed mental health professionals providing 6 free mental health services to active duty military members and their spouses. By accessing or using the MWA website (the "Site") and its services, you agree to comply with and be bound by the following Terms of Service. If you do not agree to these Terms, please do not use the Site or its services.
1. Free Services for Active Duty Military and Their Spouses
MWA offers 6 free mental health therapy sessions to active duty military members and their spouses. After the 6 free sessions, it is the responsibility of the client and therapist to agree upon terms for the continuation of services.
2. Electronic Contracting
By using the Site or registering for the Services, you are entering into an agreement with MWA electronically. Your use of the Site or services constitutes your consent to these Terms of Service and your electronic signature.
3. Changes to These Terms
MWA reserves the right to modify, update, or change these Terms at any time. All changes will be posted on the Site, and you will be notified of the changes. Continued use of the Site after the changes will constitute acceptance of the updated Terms.
4. Arbitration and Opt-Out
If a dispute arises between you and MWA, you agree to submit to binding arbitration, except where prohibited by law. You have the right to opt out of this arbitration agreement by providing written notice to MWA within 30 days of first accessing the Site.
5. Copyright Dispute Policy
If you believe that any content on the Site violates your copyright, please submit a notification to us at the designated copyright agent.
6. Limitations of Liability
MWA will not be held liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site or Services. Our total liability is limited to the amount paid for Services provided under these Terms.
7. Liability Disclaimer
MWA provides no guarantees as to the effectiveness, availability, or accuracy of the Site and Services. We do not provide medical or mental health advice and the services provided are not a substitute for professional medical care.
8. Confidentiality and Non-Disclosure
Therapists may receive confidential and proprietary information during the course of providing services. Therapists agree:
Not to disclose this information to any third party without MWA’s consent, except as required by law.
To store and dispose of confidential information securely, in accordance with applicable laws, including HIPAA.
9. No Unlawful or Prohibited Use
You may not use the Site for any unlawful or prohibited purpose. Specifically, you agree not to:
Post or send unsolicited emails or advertisements.
Use malicious software or viruses.
Post or share abusive, harmful, or offensive content.
10. Indemnification
You agree to indemnify and hold harmless MWA, its officers, employees, and affiliates from any claims, losses, or damages (including legal fees) resulting from your use of the Site or breach of these Terms.
11. Fees
$75 Application Fee: There is a one-time, non-refundable application fee of $75. This fee is charged to clients when applying to access their 6 free counseling sessions and this fee is not refundable under any circumstances.
Beyond the 6 free sessions, the cost of continued services must be agreed upon between the client and therapist.
12. Insurance Coverage
Therapists are required to maintain adequate professional liability insurance or errors and omissions insurance. MWA may request a certificate of insurance at any time.
13. Responsibilities of Therapists
Therapists are responsible for:
Providing services in compliance with applicable laws, regulations, and professional ethics.
Maintaining accurate records for each client, ensuring the confidentiality and protection of personal health information (PHI).
Informing MWA of any criminal charges or proceedings affecting their professional conduct.
14. Personal and Medical/Health Information
MWA respects the privacy of its clients and therapists. We will never sell your personal data or health information. MWA is committed to protecting your personal health information (PHI) in compliance with HIPAA and other applicable privacy laws.
15. No Doctor/Mental Health Professional-Patient Relationship
The services provided through MWA do not constitute a formal doctor-patient or therapist-client relationship. MWA is not engaged in the practice of medicine or providing medical or mental health advice.
16. Eligibility for Services
To be eligible for the free mental health services, clients must be active duty military members or their spouses. Therapists must be licensed professionals in good standing with relevant licensing boards in their state of practice.
17. Emergencies
MWA does not provide emergency services. If a client is in a life-threatening situation, they must immediately contact 911 or other emergency services. MWA's therapists are not authorized to provide emergency or crisis care.
18. Medical Diagnoses
Therapists are prohibited from diagnosing medical conditions or prescribing medications. The services provided are purely mental health therapy.
19. Background Checks and Criminal Activity
Therapists must undergo background checks as part of the application process. If any criminal charges are filed against a therapist, they must notify MWA immediately.
20. Termination of Agreement
MWA reserves the right to modify, suspend, or terminate any therapist’s participation in the network at any time, with or without notice. Clients may also terminate their use of the Site or services at any time.
21. Account Security
Therapists are responsible for maintaining the security of their account, including passwords and other confidential information. Unauthorized access or use of an account must be reported to MWA immediately.
22. Intellectual Property
Therapists must not use the intellectual property of any individual or organization without proper authorization. This includes the use of copyrighted materials, trademarks, or proprietary content on the Site.
23. No Authority to Contract on Behalf of MWA
Therapists do not have the authority to enter into contracts or commitments on behalf of MWA. They are independent contractors and are not employees or agents of MWA.
24. Technology and Equipment
Therapists are responsible for providing their own equipment and technology needed to offer services through the Site.
25. Prohibited Behavior
Therapists must not engage in activities outside of their professional competence or engage in therapy that is not legally permitted or that violates their licensure.
26. Eligibility and Services Provided
MWA provides 6 free therapy sessions for eligible clients (active duty military members and their spouses). After the initial free sessions, therapists and clients will discuss and agree on any future services and fees.
27. Acknowledgment
By accessing or using the Site, both clients and therapists acknowledge that they have read, understood, and agree to comply with these Terms of Service.
TERMS OF SERVICE/THERAPISTS
Terms of Service for Therapists
Agreement with Mindful Warrior Alliance
These Terms of Service constitute an agreement ("Agreement") between you ("Therapist") and Mindful Warrior Alliance ("MWA"). Therapists, who are licensed professionals, provide mental health services ("Services") to individuals accessing the MWA Site.
To access certain aspects of the Site or perform certain functions, Therapists must become "Network Therapists" with MWA. As part of the registration process, you will review these Terms and agree to be bound by them.
Changes to These Terms
MWA reserves the right to change these Terms at any time. If there are any changes, MWA will post an amended agreement with notice of the changes. Your continued use of the Site and Services constitutes acknowledgment and agreement to the new Terms.
Electronic Contracting
Your use of the Site constitutes your electronic signature to these Terms and your consent to enter into agreements electronically.
Entire Agreement
This written Agreement represents the entire understanding between the Therapist and MWA. All prior understandings, whether written or oral, are superseded by this Agreement.
Severability
If any provision of this Agreement is held to be invalid or unenforceable, the remainder of the Agreement will continue in full effect.
Independent Contractor Relationship
Therapists are independent contractors, not employees of MWA. This Agreement does not create an employer/employee relationship or any agency, joint venture, or partnership between MWA and the Therapist.
Applicable Laws
Therapists agree to comply with all applicable local, state, federal, and international laws, statutes, and ethical codes.
No Minimum Commitment
MWA does not guarantee any work, income, or referrals to Therapists, nor any specific number or volume of interactions with clients.
Marketing Activities
MWA will obtain the Therapist's consent before using their name for marketing purposes.
Background Checks
MWA may conduct background checks on Therapists at any time.
Criminal Activity
Therapists must inform MWA immediately of any felony charges or convictions, or any charges involving moral turpitude.
Licensure and Fitness
Therapists affirm that they are licensed to provide services and comply with all applicable regulations and laws. They agree to provide proof of licensure upon request.
Confidentiality
Therapists agree to maintain the confidentiality of any personal or health information received from clients, as well as any proprietary or confidential information of MWA.
